David Poirier is a Senior Attorney at Hirzel Law, PLC, specializing in complex commercial litigation. Mr. Poirier has extensive experience in handling a broad range of legal matters, including ownership and shareholder disputes, automotive parts supplier disputes, sales commission disputes, intellectual property and patent infringement, trade secret misappropriation and non-compete disputes, healthcare law, environmental law, insurance coverage, professional malpractice defense, and various business torts.
Mr. Poirier began his legal career at a national law firm in Chicago, focusing on environmental law, a highly regulated and technical field. His experience in this area fostered a collaborative approach, where client and attorney work together to develop innovative solutions. He carries this methodology into his litigation practice, working closely with clients to understand their business objectives and crafting strategies to achieve those goals. - Real Estate Development Trial: Successfully first-chaired a trial in Chicago involving a $30 million real estate development, obtaining a “to the dollar” judgment for all client damages and attorneys’ fees.
- Lender Liability Arbitration: First-chaired an arbitration involving claims of fraud, breach of contract, and business torts, leading to the dismissal of claims following Mr. Poirier’s cross-examination.
- Information Technology Trial: Defended an IT consulting firm in a $25 million ERP software system implementation dispute, managing extensive discovery and preparing witnesses, resulting in a favorable trial outcome.
- Automotive Supplier Trial: Secured a significant settlement for an automotive supplier in a trade secret misappropriation case through strategic trial preparation and effective discovery management.
- Commercial Real Estate Commission Trial: Second-chaired a two-week jury trial, achieving a “to the dollar” verdict for a national commercial real estate brokerage firm.
- Professional Malpractice Defense Trial: Played a key role in defending a high seven-figure attorney malpractice claim, contributing to a favorable jury verdict through thorough witness preparation and day-to-day management.
- Accountant Malpractice Defense Litigation: Successfully defended a national accounting firm in a $5 million malpractice claim, obtaining a dismissal in federal court and preserving the win on appeal before the Sixth Circuit Court of Appeals.
