Hirzel Law is pleased to announce that a new On Demand Seminar featuring attorney Kevin Hirzel is now available through the Institute of Continuing Legal Education (ICLE). The seminar focuses on fair housing, one of the most consequential and frequently litigated areas of community association law. Kevin is joined by Brian Harris of The Meisner Law Group, P.C., a Michigan condominium and community association firm, and by Nicole McNair, a staff attorney with ICLE.
Fair housing is an area where a single accommodation request or community rule can turn into a claim faster than most boards expect. Residential community associations must comply with the federal Fair Housing Act as well as Michigan’s Elliott-Larsen Civil Rights Act, which together protect owners and occupants from discrimination based on characteristics such as race, color, religion, sex, national origin, familial status, and disability. Because these laws are highly fact-specific and full of nuance, even well-intentioned boards can find themselves exposed to liability.
In the seminar, the panel explains how fair housing claims are initiated and move through the process, the theories of liability that can arise under the Fair Housing Act, and the protected categories that most often generate disputes for condominium and homeowners associations. The discussion ties each concept back to the everyday decisions boards face, including how associations respond to accommodation requests and how they draft and enforce the rules that govern their communities.
