The article covers the ongoing deconversion vote at 200 North Dearborn Street in Chicago, where unit owners are considering a $98 million bulk purchase offer from YK Investments, a venture led by Strategic Properties of North America’s Yitzy Klor. As the vote nears its close, tensions have escalated: the buyer’s brokers have suggested that unit owners organizing against the sale could face tortious interference claims, while owners contend those threats may run afoul of Illinois anti-SLAPP protections.
Kevin, who is not involved in the 200 North Dearborn dispute, provided perspective on the legal standards that govern deconversion negotiations. He noted that “there’s no law that would prevent communication from these parties to each other” during the deconversion process. He also explained that tortious interference claims against unit owners face a demanding burden of proof: “You have to show that somebody has done something specifically for the purpose of interfering with the business expectancy, if that’s the claim, or interfering with the contract. It’s a fairly high standard to establish that type of claim.”
Under the Illinois Condominium Property Act, a bulk sale requires approval from 75% of unit owners, and a City of Chicago ordinance raises that threshold to 85% for buildings within the city.
